Anthony R. Elman of Elman Law Group, LLC has successfully achieved a $621,000 jury verdict involving a wrist fracture stemming from a Chicago car accident. The case, John Calhoun vs. Peter Ochoa, was tried in Cook County Circuit Court, Chicago, Illinois.

Elman Law Group took the case to trial after there was a Last Offer to Settle by Defendant (American Family Insurance In House Counsel) of $45,000.

The case involved a 36-year-old plaintiff who was involved in a Chicago car accident, which happened when the defendant, insured by American Family Insurance Company, allegedly failed to yield the right-of-way when his car made a left-hand turn in front of the plaintiff’s car. The plaintiff, who was the front-seat passenger in the car, suffered a wrist injury to his right arm when the deployed airbag hit his arm. The plaintiff had about 2-3 months of post-accident treatment for this wrist fracture. No invasive surgery was ever needed. The treatment consisted of pain medications, wearing a hand cast, physical therapy, and closed reduction non-invasive outpatient surgery. The defense was allowed to introduce into evidence that the plaintiff had a recent felony criminal conviction.

Plaintiff’s medical bills were about $21,000. Anthony Elman’s last settlement demand was $50,000.

Wadsworth Fatal Motorcycle-Car Collision

There was a fatal motorcycle collision Saturday evening (February 18, 2017) in Wadsworth.

According to preliminary crash investigation findings from the Lake County Sheriff’s Office, the crash happened on Route 41, north of Route 173, at approximately 8:00 p.m.  At that time, a southbound 2013 Harley-Davidson motorcycle “rear-ended” a 1985 Pontiac Fiero.

During the collision, the motorcyclist was ejected from the bike.  He was pronounced dead at the accident scene.  The motorcyclist has been identified at this time only as a 42-year-old man from Beach Park.

At the time of the crash the motorcyclist was not wearing a motorcycle helmet.

The driver of the Fiero, identified as a 63-year-old man from Gurnee, was not injured during the crash.

Motorcycle Crash In Fox Lake Leads To Fatality And Injury

There was a fatal motorcycle crash Tuesday (February 14, 2017) in Fox Lake.

According to witness accounts of the accident, the crash involved a loss of control of the motorcycle.

An excerpt from the February 15, 2017 Lake County News-Sun article titled “Fox Lake police:  Cellphone distraction leads to fatal motorcycle crash“:

The driver, 45-year-old Mark Dittmer of the 600 block of Mohawk Drive in Round Lake Heights, was riding a 2016 Harley Davidson motorcycle just after 5 p.m. on Rollins near Rainier Way, west of Route 59, when his cellphone rang, according to Deputy Chief Jim Lee of the Fox Lake Police Department.

“According to witnesses, the cellphone rang, and he was handing it back to his fiancee riding on the back when he lost control,” he said.

Neither Dittmer or the female passenger were wearing motorcycle helmets at the time of the crash.

Preliminary crash investigation findings indicate that after falling from the motorcycle, Dittmer hit his head on an adjacent asphalt bicycle path.  He died at the accident scene.

His 42-year-old female passenger was reported to have minor injuries resulting from the crash.

The crash investigation is being handled by the  Fox Lake Police Department and the Lake County Major Crash Assist Team (MCAT.)

Newly-released research seen in Medline Plus (National Institutes of Health) discusses another factor that appears to have an influence on truck crashes – the health of the truck driver.

An excerpt from the January 19, 2017 Medline Plus page titled “Truckers’ Poor Health:  An Accident Waiting to Happen?“:

Researchers examined data from more than 49,000 commercial truck drivers and found that 34 percent had at least one of several health problems — such as heart disease, low back pain and diabetes — that have been linked with poor driving performance.

Truck drivers with three or more of the flagged medical conditions were two to four times more likely to be in a crash than their healthier peers, the University of Utah researchers found.

For example, the rate of crashes resulting in injury among all truck drivers was 29 per 100 million miles traveled, but was 93 per 100 million miles traveled for drivers with three or more of the identified health problems.

However, the study wasn’t designed to prove a cause-and-effect link.

Fatal Car Crash In Zion

There was a fatal vehicle collision early Saturday morning (February 4, 2017) in Zion.

One person, a 17-year-old Waukegan High School sophomore identified as Malik Brown, died in the crash.

Other students were injured and hospitalized.

An excerpt from the Lake County News-Sun article of February 7, 2017, titled “Zion police:  Excessive speed led to crash that killed Waukegan student“:

Malik Brown was driving a 2017 Nissan Sentra, traveling west on Carmel Boulevard at 12:30 a.m. Saturday when he entered the intersection at Galilee Avenue without stopping at a stop sign, according to a statement released Tuesday by the Zion Police Department. There were four passengers ranging in age from 16 to 20 in the vehicle, according to police.

After swerving to avoid a vehicle that was southbound on Galilee, there was a loss of vehicle control and the car went off the roadway west of the intersection.  The car then hit a tree.

Brown had to be extricated from the vehicle, after which he was flown to Advocate Condell Medical Center in Libertyville.  He was pronounced dead there.  Three passengers were also taken to hospitals for treatment of their accident injuries, and they were reported to be in stable condition.

Speed was a contributing factor in the crash.  This fatal car crash remains under investigation by the Zion Police Department’s Accident Investigation Unit.

Fatal Single-Car Crash In Wauconda

There was a fatal single-car accident Thursday (February 2, 2017) in Wauconda.  One man died from accident injuries.

According to preliminary information provided by the Lake County Sheriff’s Office, the accident happened at approximately 5:15 p.m., as a man was driving a 2000 Buick Regal northbound on Darrell Road, south of Case Road.

At that time, for reasons currently undetermined, the driver lost control of the car and the car left the roadway, going into a ditch.  The car then collided head-on with a tree.

The man, currently identified only as a 62-year-old man from Wonder Lake, was taken to a local hospital, where he was declared dead.

Crash investigators responded to the scene and continue to investigate if drugs, alcohol, and/or speed were a factor in the crash.
