Elman Law Group, LLC Wins Big With A Stunning $621,000 Jury Verdict In Cook County (Chicago, Illinois) “Wrist Fracture” Car Accident Case

Anthony R. Elman of Elman Law Group, LLC has successfully achieved a $621,000 jury verdict involving a wrist fracture stemming from a Chicago car accident. The case, John Calhoun vs. Peter Ochoa, was tried in Cook County Circuit Court, Chicago, Illinois.

Elman Law Group took the case to trial after there was a Last Offer to Settle by Defendant (American Family Insurance In House Counsel) of $45,000.

The case involved a 36-year-old plaintiff who was involved in a Chicago car accident, which happened when the defendant, insured by American Family Insurance Company, allegedly failed to yield the right-of-way when his car made a left-hand turn in front of the plaintiff’s car. The plaintiff, who was the front-seat passenger in the car, suffered a wrist injury to his right arm when the deployed airbag hit his arm. The plaintiff had about 2-3 months of post-accident treatment for this wrist fracture. No invasive surgery was ever needed. The treatment consisted of pain medications, wearing a hand cast, physical therapy, and closed reduction non-invasive outpatient surgery. The defense was allowed to introduce into evidence that the plaintiff had a recent felony criminal conviction.

Plaintiff’s medical bills were about $21,000. Anthony Elman’s last settlement demand was $50,000.

Fatal Lake County Pedestrian Accident In Antioch Township

There was a fatal Lake County pedestrian accident Saturday (June 9, 2018) night in Antioch Township.  The accident involved a vehicle hitting a man who was walking at the time of the accident.  After the collision, the driver left the accident scene (i.e. it was a “hit & run.”)

According to information provided by the Lake County Sheriff’s Office, in a June 10, 2018 media release titled “Fatal Antioch Township Hit-And-Run,” Sheriff’s Deputies were called to the accident scene at approximately 9:30 p.m.  The accident happened in the area of West Grass Lake Road and North Sunset Drive.

An excerpt from the media release:

Sheriff’s Deputies arrived and found the male pedestrian on Grass Lake Road (on the north shoulder, approximately 500 feet east of Sunset Drive) critically injured.  The man was transported to Advocate Condell Medical Center in Libertyville, where he was pronounced deceased.  The driver that struck the man fled the scene in the striking-vehicle, prior to the arrival of Sheriff’s Deputies.

The pedestrian was later identified as Brett Beckett, 52, of Antioch.

The accident investigation is being conducted by the Lake County Sheriff’s Office Technical Crash Investigations Unit.

The Motorcycle Left The Roadway During Antioch Township Crash

There was a motorcycle crash Monday (June 4, 2018) in which the motorcycle left the roadway in Antioch Township.   As previously mentioned on this site, there have been many Illinois motorcycle accidents in 2018 which have involved a loss of motorcycle control.  As discussed on the “Motorcycle Loss Of Control Accidents” page, a loss of control can happen for many different reasons.

According to the Lake County Sheriff’s Office, in the June 5, 2018 media release titled “Critical Antioch Township Motorcycle Crash,” deputies responded to the motorcycle accident scene, which was in the 43000 block of North Trevor Road, at approximately 7:37 p.m.

An excerpt from the release:

Preliminary investigation shows a Harley-Davidson motorcycle, driven by a 51-year-old Zion man, was southbound on North Trevor Road. For an unknown reason, the motorcycle left the roadway and went into a wooded area. The driver was not wearing a helmet and he was ejected from the motorcycle. The man was transported to St. Catherine’s Medical Center in Pleasant Prairies, Wisconsin, with serious injuries.

The crash remains under investigation by the Lake County Sheriff’s Office Technical Crash Investigations Unit.

Driver Dies After Car Drove Into A Pond In Libertyville

A car drove into a pond Monday (June 4, 2018) evening in Libertyville.  The driver of a car later died.

Details regarding the incident are limited at this time.  It is unknown if the crash involved a loss of control as the cause of the crash remains under investigation.

According to Libertyville Police, the car was partially submerged in a pond near Route 45 and Northwind Boulevard.  The driver was later identified as Abner Abdiel Melgar-Barrientos, 36, of Round Lake Beach.

Dispatch first received calls at about 4:46 p.m. Monday. Several fire department rescue teams from throughout Lake County were requested in an effort to rescue the driver from the submerged car, according to the police statement.

The crash is being investigated by the Libertyville Police Department, the Lake County Coroner’s Office and the Lake County Major Crash Assistance Team.

Wauconda Township Car Crash Critically Injures Driver

A car crash critically injures driver in Wauconda Township on May 31, 2018.  The crash involved a car that left the roadway after an apparent loss of control.

An excerpt regarding the crash, from the Lake County Sheriff’s Office media release of June 1, 2018, titled “Critical Wauconda Township Crash“:

On May 31, 2018, at approximately 11:00PM, Lake County Sheriff’s Deputies responded to the area of West Ivanhoe Road and West Brown Road, Wauconda Township, for a traffic crash with injuries.  When Sheriff’s Deputies arrived they located a 2018 Subaru WRX with extensive damage.  The driver of the vehicle, a 51 year-old man of Island Lake, was unconscious and entrapped inside the vehicle.

The man was extricated from the vehicle and taken to Advocate Condell Medical Center in Libertyville for treatment of his accident injuries.  Those injuries were critical injuries and were considered to be life-threatening in nature.

A preliminary investigation indicated that before the crash the driver was heading northbound on West Brown Road.  For a currently undetermined reason, he failed to negotiate a curve, and the car left the roadway and struck a tree.

The accident investigation into this Lake County car accident is being conducted by the
Lake County Sheriff’s Office Technical Crash Investigations Unit.

Driving While Impaired By Drugs Frequency During Fatal Crashes

Driving while impaired by drugs is becoming increasingly common, and, in addition to drunk driving, continues to be a significant traffic safety issue both nationally as well as locally, such as in Lake County as well as throughout the Chicago area.   This “drugged driving” can include many drugs, with commonly-involved drugs including marijuana, heroin, meth, and cocaine.  If “mixed drug use” occurs, the level of impairment can increase.  As well, if alcohol is used with the drugs, an increased level of impairment can occur.  The subject of drug-impaired driving is further discussed on the “Car Accidents Involving Drivers Under The Influence Of Drugs” page.   Various Lake County accidents in which the driver was impaired by drugs are mentioned.  As seen in these accidents, many result in serious injuries, and some of these injuries resulted in fatalities.

new report from the Governors Highway Safety Association (GHSA) finds that in 2016, 44% of fatally-injured drivers with known results tested positive for drugs, up from 28% just 10 years prior. More than half of these drivers had marijuana, opioids, or a combination of the two in their system.

“Too many people operate under the false belief that marijuana or opioids don’t impair their ability to drive, or even that these drugs make them safer drivers,” noted GHSA Executive Director Jonathan Adkins. “Busting this myth requires states to expand their impaired driving campaigns to include marijuana and opioids along with alcohol to show drivers that impairment is impairment, regardless of substance.”
