Anthony R. Elman of Elman Law Group, LLC has successfully achieved a $621,000 jury verdict involving a wrist fracture stemming from a Chicago car accident. The case, John Calhoun vs. Peter Ochoa, was tried in Cook County Circuit Court, Chicago, Illinois.

Elman Law Group took the case to trial after there was a Last Offer to Settle by Defendant (American Family Insurance In House Counsel) of $45,000.

The case involved a 36-year-old plaintiff who was involved in a Chicago car accident, which happened when the defendant, insured by American Family Insurance Company, allegedly failed to yield the right-of-way when his car made a left-hand turn in front of the plaintiff’s car. The plaintiff, who was the front-seat passenger in the car, suffered a wrist injury to his right arm when the deployed airbag hit his arm. The plaintiff had about 2-3 months of post-accident treatment for this wrist fracture. No invasive surgery was ever needed. The treatment consisted of pain medications, wearing a hand cast, physical therapy, and closed reduction non-invasive outpatient surgery. The defense was allowed to introduce into evidence that the plaintiff had a recent felony criminal conviction.

Plaintiff’s medical bills were about $21,000. Anthony Elman’s last settlement demand was $50,000.

Fatal Volo Collision On Route 120 Involving Car And SUV

There was a fatal Volo collision on Wednesday (April 18, 2018) afternoon.  The collision involved a SUV and a car on Route 120 near Ellis Drive.

According to information provided by the Lake County Sheriff’s Office, first responders began going to the accident scene just after 12:20 p.m.  The accident scene was at Route 120 at Ellis Drive.

An excerpt regarding the crash, from the April 19, 2018 Lake County News-Sun article titled “Round Lake Park woman killed in Volo crash.”  An excerpt, quoting Sheriff’s Office Sgt. Sara Balmes:

Results of a preliminary investigation determined that a red sport utility vehicle driven by a 55-year-old woman from Gurnee was eastbound on Route 120 when, “for an unknown reason,” a white sedan entered the eastbound lanes of Route 120 and was struck by the SUV, officials said. The crash occurred west of Ellis Drive.

The driver of the white sedan, a 24-year-old woman from Round Lake Park, was transported to an area hospital where she was pronounced dead, Balmes said.

The 24-year-old woman was subsequently identified by the Lake County Coroners Office as Susana Ortega, 24, of Round Lake Park.  An autopsy revealed she died from traumatic injuries due to the collision.

The driver of the SUV was taken to a hospital for treatment of accident injuries that were considered to be non-life-threatening in nature.

This fatal Volo collision is being investigated by the Lake County Sheriff’s Office Technical Crash Investigations Team.

DUI Charges After Erratic Driving On Route 41 In Lake Forest

Lake County Driver Distraction Traffic Safety Problem

Driver distraction continues to be a significant threat to safe travel in Illinois, including Lake County.  “Distracted driving” can be caused by many different activities that divert the attention of the driver.  Among the most common reasons for driver distraction is operating a cell phone – and especially texting while driving.  In many cases this resulting lack of attention can directly or indirectly lead to a loss of vehicle control and/or a traffic accident.

Sheriff Mark Curran stated, “Texting and driving is dangerous. If a motorist is caught with a phone in one hand, they can expect a ticket in the other. The purpose of the campaign is to reduce distracted driving and reduce traffic crashes.”

Texting while driving distracts the driver visually, manually and cognitively, putting everyone on the road at risk. Sending or receiving a text takes a driver’s eyes off the road for an average of 4.6 seconds, the equivalent of driving blind at 55 mph for the length of an entire football field.

Buffalo Grove Multi-Vehicle Accident Injures 10 People

There was a multi-vehicle accident involving four vehicles Wednesday (April 11, 2018) in Buffalo Grove.  Ten people were injured during the crash.

Details on the accident and the injuries appear limited.  The cause of the crash does not appear to be publicly disclosed.

The crash happened at approximately 10:30 p.m., at Lake-Cook Road and McHenry Road.

Among those injured, one person had to be extricated from a vehicle.

The ten people injured were taken to five different hospitals for medical treatment.

Police said Saul Hernandez-Rivera, 39, of the 3200 block of South Pulaski Road, Chicago, caused the crash and was charged with driving on a suspended license, disobeying a traffic signal and failure to wear a seat belt.

Unincorporated Lake Villa Crash Involving SUV Leaving The Roadway

There was a Lake County crash Tuesday (April 3, 2018) in unincorporated Lake Villa.  The crash involved a SUV leaving the roadway and crashing into a gas line.

An excerpt from the Lake County Sheriff’s Office April 4, 2018 media release titled “Unincorporated Lake Villa Single Vehicle Collision“:

On April 3, 2018, at approximately 4:55 PM the Lake County Sheriff’s Office responded to a report of a single-vehicle crash on Route 45 north of Grand Avenue in unincorporated Lake Villa. Witnesses reported the vehicle went off the roadway and struck a gas line.

The preliminary accident investigation indicated that a 2000 Ford Expedition SUV had been traveling southbound on Route 45 and the SUV leaving the roadway to the east.  It is not known what caused this apparent loss of vehicle control.

The driver, the vehicle’s sole occupant, was identified as a 16-year-old male.  He was taken to Advocate Condell Medical Center for treatment of his accident injuries, and was reported to be in critical condition.

The truck struck a gas line, and caused a significant leak.

The accident investigation continues and is being conducted by the Lake County Sheriff’s Office Technical Crash Investigations Unit.
