Elman Law Group, LLC Wins Big With A Stunning $621,000 Jury Verdict In Cook County (Chicago, Illinois) “Wrist Fracture” Car Accident Case

Anthony R. Elman of Elman Law Group, LLC has successfully achieved a $621,000 jury verdict involving a wrist fracture stemming from a Chicago car accident. The case, John Calhoun vs. Peter Ochoa, was tried in Cook County Circuit Court, Chicago, Illinois.

Elman Law Group took the case to trial after there was a Last Offer to Settle by Defendant (American Family Insurance In House Counsel) of $45,000.

The case involved a 36-year-old plaintiff who was involved in a Chicago car accident, which happened when the defendant, insured by American Family Insurance Company, allegedly failed to yield the right-of-way when his car made a left-hand turn in front of the plaintiff’s car. The plaintiff, who was the front-seat passenger in the car, suffered a wrist injury to his right arm when the deployed airbag hit his arm. The plaintiff had about 2-3 months of post-accident treatment for this wrist fracture. No invasive surgery was ever needed. The treatment consisted of pain medications, wearing a hand cast, physical therapy, and closed reduction non-invasive outpatient surgery. The defense was allowed to introduce into evidence that the plaintiff had a recent felony criminal conviction.

Plaintiff’s medical bills were about $21,000. Anthony Elman’s last settlement demand was $50,000.

Accidents Caused By Road Hazards

One cause of accidents is traffic hazard is “road hazards.”  While there are many types of road hazards, such road hazards have potential to cause (or contribute to) vehicle accidents.  Such accidents have led to various accident injuries and/or fatalities.  The issue of traffic hazards in Lake County is discussed in posts found in the “Traffic Safety” category.

One recent notable road hazard was experienced in Boston on Friday, February 12.  It involved a manhole cover, weighing over 200 pounds, becoming dislodged and going “airborne.”  The manhole cover then smashed into and through a car traveling through inside the Thomas P. O’Neill Tunnel.  The driver of the car was killed in the accident.

An excerpt from the Boston Globe article (with pictures) of February 12, 2016, titled “Woman struck by manhole cover inside O’Neill Tunnel, suffers fatal injuries“:

State Secretary of Transportation Stephanie Pollack described what happened as a “very rare event.”

“They’re pretty hard to dislodge and even harder to get airborne,” she told reporters at the State House Friday afternoon.

State Police are investigating what caused the manhole to become dislodged. The manhole covers a storm drainage system and was last inspected in June 2014. At the time of the inspection, it rated “very good,” Pollack said.

Additional details and possible updates regarding this fatal accident can be seen in a variety of media sources, including the Boston Globe article mentioned above, as well as the February 12 myfoxboston.com article titled “Woman killed after manhole cover strikes car on Rte. 93.”

Icy Roadways Throughout Lake County

Early this morning (February 1, 2016) there was freezing rain throughout Lake County, which made for adverse driving conditions.  The icy road conditions contributed to many crashes.  Undoubtedly, “black ice” was present in many areas, further contributing to slick roadways.  For those unaware, “black ice” occurs when a thin coating of clear ice forms over a roadway.  The resulting condition is a very slippery road surface.  “Black ice” is especially hazardous as it can be very difficult to see, especially at night.  “Black ice” can lead to loss of vehicle control and, in many cases, (serious) vehicle accidents.

The various car accidents of this morning are summarized in a variety of media sources, including the February 1, 2016 Daily Herald article titled “Slick roads are reported in Lake, McHenry counties” as well as the February 1 Huntley Patch article titled “Slippery Roadways Causing Crashes in Lake, McHenry Counties: Police.”

An excerpt from the Patch article:

Police have reported several crashes in Lake and McHenry counties, including in Volo, Grayslake, Kildeer and Third Lake, the Daily Herald reports.

As well, one can see that there were crashes and stalls reported in a broad array of Lake County cities and towns, including Lake Forest, Round Lake, Mundelein, Hawthorn Woods and Volo, to name a few.  While it is unknown as to whether all of these crashes were due to icy conditions, undoubtedly such adverse driving conditions were (at least) a contributing factor.
