Anthony R. Elman of Elman Law Group, LLC has successfully achieved a $621,000 jury verdict involving a wrist fracture stemming from a Chicago car accident. The case, John Calhoun vs. Peter Ochoa, was tried in Cook County Circuit Court, Chicago, Illinois.

Elman Law Group took the case to trial after there was a Last Offer to Settle by Defendant (American Family Insurance In House Counsel) of $45,000.

The case involved a 36-year-old plaintiff who was involved in a Chicago car accident, which happened when the defendant, insured by American Family Insurance Company, allegedly failed to yield the right-of-way when his car made a left-hand turn in front of the plaintiff’s car. The plaintiff, who was the front-seat passenger in the car, suffered a wrist injury to his right arm when the deployed airbag hit his arm. The plaintiff had about 2-3 months of post-accident treatment for this wrist fracture. No invasive surgery was ever needed. The treatment consisted of pain medications, wearing a hand cast, physical therapy, and closed reduction non-invasive outpatient surgery. The defense was allowed to introduce into evidence that the plaintiff had a recent felony criminal conviction.

Plaintiff’s medical bills were about $21,000. Anthony Elman’s last settlement demand was $50,000.

Fatal Single-Car Accident In Waukegan

There was a fatal car accident Thursday (August 25, 2016) night in Waukegan.  The accident involved a loss of control of the car.

According to Waukegan Police, the single-vehicle accident happened on Westmoreland Avenue at Crescent Avenue, as show below:

According to the Waukegan Police Department, the accident happened at approximately 11:00 p.m., as the car was heading southbound on Westmoreland Avenue.  The driver lost control of the car and the car struck a utility pole at Crescent Avenue.

The driver was identified as David C. Collins, 20, of North Chicago.  He was declared dead at the accident scene.  At the time of the crash, he was not wearing a seat belt.

The Waukegan Police Department’s Traffic Division is investigating the crash and believes that speed was a factor. More information about how fast the car was going at impact is expected to be learned next week when the car’s black box is downloaded.

Fatal Head-On Crash On Route 173 In Antioch

There was a fatal car collision in Antioch on Friday (August 19, 2016) morning.  According to a preliminary traffic accident investigation by the Antioch Police, the collision was a “head on collision” between a car and pickup truck on Route 173.

The collision happened at approximately 7:30 a.m. in the 1000 block of West Route 173.  It is currently undisclosed as to what caused the “head on collision” or what party may be at fault.  At the time of the collision, the car was westbound on Route 173 and the pickup truck was pickup truck was eastbound.

Both drivers had to be extricated from their vehicles.  The driver of the car, identified as Dylan Smith, 17, was pronounced dead at the accident scene.  The pickup truck driver was taken to Advocate Condell Medical Center in Libertyville for treatment of his accident injuries.  His injuries were considered to be non-life-threatening in nature.

The accident continues to be under investigation by Antioch Police Department and the Lake County Major Crash Assistance Team.  As part of the traffic crash investigation, both directions of Route 173 in the vicinity of the accident scene were closed for more than four hours.

According to the Lake Forest Fire Department, the accident happened at approximately 11:30 a.m., and the single-car accident involved an apparent loss of control.

Fatal Motorcycle Accident Near Libertyville

There was a fatal motorcycle accident Friday morning (August 12, 2016) near Libertyville.

According to the Lake County Sheriff’s Office, the accident happened at 11:18 a.m., as a motorcyclist was heading northbound on Milwaukee Avenue.  As he attempted to turn left onto Casey Road, he collided with a box truck traveling southbound on Milwaukee Avenue.

The motorcyclist was ejected from his motorcycle during the crash.  At the time of the collision he was not wearing a helmet.  He was taken to Advocate Condell Medical Center for treatment of his accident injuries, where he died.  At this time he is being identified only as a 59-year-old man.

The man’s name is not being released until family is notified. The Lake County Technical Crash Assistance Team was on the scene and investigators are talking to witnesses about what color the traffic signals were and other contributing factors, Covelli said.

Road Hazards As An Accident Cause

Road hazards are a subject that has been discussed often on this site, as such road hazards are potentially dangerous for motorists.  One reason for this danger is that road hazards are often unexpected, and there can be little if no advanced warning as to their presence.  Road hazards can take many forms, including foreign items that are sitting on the roadway, or items have fallen off of other vehicles.  These various road hazards have caused or contributed to many Illinois crashes.

On August 11, 2016, the AAA Foundation for Traffic Safety released findings from a research report titled “The Prevalence Of Motor Vehicle Crashes Involving Road Debris, United States, 2011-2014.”  The report highlights the incidence of accidents caused by road hazards.  The report factors in crashes by vehicles including cars, pickup trucks, vans, minivans, and SUVs.  The report highlights the extent of road hazards causing accidents, particularly those on highways.

As stated in the report’s Fact Sheet:

Between 2011-2014, road debris was a factor in a total of more than 200,000 police-reported crashes

Resulted in a total of approximately 39,000 injuries and 500 deaths

The Fact Sheet defines road hazards as:

Road debris is defined in the current study as debris from any source, including by not limited to vehicles, that can pose a significant safety hazard (animals in the road, trees that fell onto vehicles, debris caused by a previous crash, and construction-related materials in active work zones were not counted as debris)

Also, the fact sheet mentions that:

About two-thirds of debris-related crashes are the result of items falling from a vehicle due to improper maintenance and unsecured loads.

The report is also discussed in the August 11, 2016 abcnews.com article (with video) titled “New Study Shows Risks of Road Debris in Highway Crashes.”  The video in the article shows various accidents caused by road hazards, including a motorcyclist getting into an accident after a large item falls from the vehicle traveling in front of it.  The item falls directly into the path of a motorcycle.  The motorcyclist is ejected from the motorcycle during this accident.
