Anthony R. Elman of Elman Law Group, LLC has successfully achieved a $621,000 jury verdict involving a wrist fracture stemming from a Chicago car accident. The case, John Calhoun vs. Peter Ochoa, was tried in Cook County Circuit Court, Chicago, Illinois.

Elman Law Group took the case to trial after there was a Last Offer to Settle by Defendant (American Family Insurance In House Counsel) of $45,000.

The case involved a 36-year-old plaintiff who was involved in a Chicago car accident, which happened when the defendant, insured by American Family Insurance Company, allegedly failed to yield the right-of-way when his car made a left-hand turn in front of the plaintiff’s car. The plaintiff, who was the front-seat passenger in the car, suffered a wrist injury to his right arm when the deployed airbag hit his arm. The plaintiff had about 2-3 months of post-accident treatment for this wrist fracture. No invasive surgery was ever needed. The treatment consisted of pain medications, wearing a hand cast, physical therapy, and closed reduction non-invasive outpatient surgery. The defense was allowed to introduce into evidence that the plaintiff had a recent felony criminal conviction.

Plaintiff’s medical bills were about $21,000. Anthony Elman’s last settlement demand was $50,000.

Fatal May 23, 2017 Fox Lake Car Accident

There was a fatal car accident Tuesday afternoon (May 23, 2017) in Fox Lake.

According to information provided by the Fox Lake Police Department, Fox Lake Police were called to the accident scene, which was at the intersection of Route 12 and Big Hollow Road, shortly before 1:00 p.m.

According to preliminary accident investigation findings, the accident involved a car (a 2000 Buick LeSabre) which was driving northbound on Route 12 “rear-ending” a semi truck with a flatbed trailer which was stopped at a red light at Big Hollow Road.

The driver of the car was taken to Centegra Hospital and pronounced dead.

There were no other injuries related to the accident.

The Major Crash Assistance Team of Lake County continues to investigate the crash.

Seat Belt Usage As A Safety Measure

Semi Truck Rollover Accident On I-94 Near Wadsworth

There was a semi truck rollover accident Saturday afternoon (May 13, 2017) from which the truck driver suffered life-threatening injuries.  The accident happened on Interstate 94 near Russell Road outside of Wadsworth.

According to information provided by The Newport Township Fire Protection District, the crash involved a semi tractor-trailer driver losing control of the truck.  The truck then rolled over a guardrail on Interstate 94 outside of Wadsworth.  First responders went to the accident scene at approximately 2:26 p.m.

The truck driver had to be extracted from the truck, and then he was taken to St. Catherine’s Medical Center in Pleasant Prairie for treatment of his accident injuries.  He was then airlifted to Froedtert Hospital in Milwaukee.  His injuries were considered to be life-threatening in nature.

Fatal “Hit & Run” Pedestrian Accident Along Route 41 In Wadsworth

There was a fatal “hit & run” pedestrian accident Tuesday evening (May 9, 2017) in Wadsworth.

According to information provided by the Lake County Sheriff’s Office, a man who is believed to have been walking on the shoulder of southbound Route 41, near Hanssen Road, was fatally struck by a vehicle.  The man (later identified as Igor Avilov, 54, of Lake Bluff) was declared dead at the accident scene.

The Lake County Sheriff’s Office went to the accident scene at approximately 8:45 p.m. Tuesday.

An excerpt regarding findings from the preliminary crash investigation, quoting Sgt. Christopher Covelli of the Lake County Sheriff’s Office, as seen in the May 10 Lake County News-Sun article titled “Police seek driver in Wadsworth hit-and-run fatal accident“:

Covelli said a preliminary investigation shows the man was likely walking on the shoulder of southbound Route 41 when he was struck by a southbound vehicle. Based on evidence recovered at the scene, traffic crash investigators believe the vehicle that struck the man was a 2004-2008 silver Ford F-150 pickup.

The vehicle likely has damage to the front bumper and front passenger-side headlight assembly, according to sheriff’s reports.

This fatal “hit & run” pedestrian accident remains under investigation by the Lake County Sheriff’s Office Technical Crash Investigations Unit.

“Drugged Driving” As A Cause Of Vehicle Accidents

“Drugged Driving” (also called “drug-impaired driving”) is increasingly common, and has been a cause or contributing factor in many recent accidents in the greater Chicago area.  Drugs that are commonly used before driving include heroin, cocaine, crystal meth and marijuana, as well as prescription drugs.  However, many other drugs can be involved as well, some in combination.

On April 26, 2017, the Governors Safety Highway Association (GHSA) released a press release concerning “drugged driving.”  The release is titled “New Report Calls States to Take Action on Drug-Impaired Driving.”

A couple of notable excerpts from the release:

With more states legalizing marijuana and record numbers of people dying from drug overdoses, concerns about drug-impaired driving are escalating. While we have made progress in combatting drunk driving in recent decades, drug use by drivers continues to rise. In fact, in 2015 (the most recent national data available) drugs were present in 43% of the fatally-injured drivers with known test results, appearing more frequently than alcohol.

“As drunk driving has declined, drugged driving has increased dramatically and many of today’s impaired drivers are combining two or more substances, which has a multiplicative effect on driver impairment,” said Ralph. S. Blackman, President and CEO of Responsibility.org. “We are pleased to partner with GHSA to fill a critical gap. These training grants will prepare law enforcement to detect drug-impaired drivers and make roads safer for us all.”

  • In 2005 drugs were present in 27.8% of the fatally-injured drivers with known test results; this increased to 32.8% in 2009 and (as stated above) 43% in 2015 (page 9)
  • As seen on page 12 of the report, regarding the effects of marijuana on driving:  “In experimental settings, marijuana impairs psychomotor skills and cognitive functions associated with driving, including vigilance, time and distance perception, lane tracking, motor coordination, divided attention tasks, and reaction time (Capler et al., 2017; Compton and Berning, 2015; Hartman and Huestis, 2013; Kelley-Baker, 2014). Drivers may attempt to compensate by driving more slowly and increasing their following distance (Hartman and Huestis, 2013).”
