Elman Law Group, LLC Wins Big With A Stunning $621,000 Jury Verdict In Cook County (Chicago, Illinois) “Wrist Fracture” Car Accident Case

Anthony R. Elman of Elman Law Group, LLC has successfully achieved a $621,000 jury verdict involving a wrist fracture stemming from a Chicago car accident. The case, John Calhoun vs. Peter Ochoa, was tried in Cook County Circuit Court, Chicago, Illinois.

Elman Law Group took the case to trial after there was a Last Offer to Settle by Defendant (American Family Insurance In House Counsel) of $45,000.

The case involved a 36-year-old plaintiff who was involved in a Chicago car accident, which happened when the defendant, insured by American Family Insurance Company, allegedly failed to yield the right-of-way when his car made a left-hand turn in front of the plaintiff’s car. The plaintiff, who was the front-seat passenger in the car, suffered a wrist injury to his right arm when the deployed airbag hit his arm. The plaintiff had about 2-3 months of post-accident treatment for this wrist fracture. No invasive surgery was ever needed. The treatment consisted of pain medications, wearing a hand cast, physical therapy, and closed reduction non-invasive outpatient surgery. The defense was allowed to introduce into evidence that the plaintiff had a recent felony criminal conviction.

Plaintiff’s medical bills were about $21,000. Anthony Elman’s last settlement demand was $50,000.

Fatal 3-Vehicle Collision In Waukegan

There was a fatal crash Wednesday evening (January 11, 2017) in Waukegan.

The crash happened at near Belvidere Street (Route 120) and River Roads, and happened at approximately 5:30 p.m.

While the crash continues to be investigated, the roadway had ice and was wet at the time of the crash, which were thought to be contributing factors to the cause of the crash.

According to Waukegan Police, the crash happened when a driver, identified as David Gutierrez-Vasquez, 47, of North Chicago, lost control of the car as he was driving eastbound on Belvidere Street.  He then drove over a grass-filled median, and entered the westbound lanes, at which time his car collided with a westbound car.  That westbound car was then struck by another car.

Gutierrez-Vasquez was pronounced dead on the scene. One of the other drivers was treated for minor injuries at a hospital.

Man Fatally Struck By Pickup Truck On Sheridan Road In Beach Park

There was a fatal Lake County pedestrian accident on Monday night (January 9, 2017) in Beach Park.

Details on the accident appear somewhat limited at this time.

Preliminary investigation findings indicate that the accident happened on Sheridan Road, just north of West Yorkhouse Road, according to the Lake County Sheriff’s Office.  Deputies responded to the accident at 8:43 p.m.

The pedestrian, currently identified only as a 54-year-old man, was attempting to cross Sheridan Road from the west, when he was struck by a northbound Chevrolet Silverado pickup truck.  At the time of the crash the man was said to be wearing dark clothing.

The pedestrian was taken to Vista East Hospital for treatment of his accident injuries, which were considered to be critical in nature.  He was pronounced dead there.

The driver of the pickup truck, a 62-year-old man, was not injured during the collision.

An accident investigation is being conducted by the Lake County Sheriff’s Office Technical Crash Investigations Unit.

One cause of bicycle accident is when bicyclists are struck from behind by vehicles.  In many cases this occurs when the motorist is driving after drinking or under the influence of drugs.

One prominent example of bicyclists being struck from behind by a SUV happened in June of 2016 in Morris, Illinois.   The accident led to the death of two bicyclists.

Another prominent example of this type of fatal bicycle accident happened in Michigan (in Kalamazoo County) on June 7, 2016. Five bicyclists died and four were injured after the driver of a SUV crashed into a group of bicyclists.

Driving While Impaired – Including Driving After Drinking

Driving while impaired continues to be a major cause in Illinois traffic accidents, many of which have caused serious accident injuries.

The National Institutes of Health (NIH) on its Medline Plus page titled “Impaired Driving” discusses and defines impaired driving as:

As seen in many statistics, driving after drinking is a major issue around holidays.  The Illinois Department of Transportation issued a news release on December 28, 2016, titled “A New Year’s Resolution to Drive Sober, Buckle Up.” (pdf)

Crash data compiled by IDOT shows that in the last five years (2011-15), 49 people died in crashes on Illinois roads during the New Year’s holiday period. Twenty, or 41 percent, died in crashes involving at least one driver who had been drinking. During last year’s New Year’s holiday, 16 people lost their lives, with six fatalities, or 38 percent, as a result of crashes involving at least one driver who tested positive for alcohol.

“DUI remains one of the top contributing factors in fatal crashes around the holidays,” said Illinois State Police Director Leo P. Schmitz. “ISP Troopers will be conducting roadside safety checks and roving patrols, looking for and arresting intoxicated motorists. Remember, drive sober or get pulled over.”

Fatal I-94 Truck Accident Near Half-Day Road

There was a fatal multi-vehicle accident Friday morning (December 23, 2016) on the Tri-State Tollway (westbound I-94) near Half Day Road in Lake Forest.

According to preliminary crash investigation results, the accident happened when a westbound semi truck struck a wheel that was on the highway, causing the truck driver to lose control of the truck at 5:52 a.m.   [please note:  initially it was thought that the truck lost a wheel, causing it to lose control.]

The truck then struck a 2007 Chevrolet, before it struck the concrete median.  In doing so, the truck overturned, and the truck driver was ejected.

The truck hit a light pole when it struck the concrete median barrier and caused the light pole to fall onto eastbound traffic lanes, where it struck a 2016 Subaru.

The driver of the semi truck was declared dead at the accident scene.  He was later identified by the Lake County Coroner’s Office as Sharmarke Dahir, 25, of Louisville, Kentucky.

The driver of the Chevrolet suffered injuries that were considered to be non-life-threatening in nature, and was taken to Advocate Condell Medical Center (Libertyville) for medical treatment.
