Anthony R. Elman of Elman Law Group, LLC has successfully achieved a $621,000 jury verdict involving a wrist fracture stemming from a Chicago car accident. The case, John Calhoun vs. Peter Ochoa, was tried in Cook County Circuit Court, Chicago, Illinois.

Elman Law Group took the case to trial after there was a Last Offer to Settle by Defendant (American Family Insurance In House Counsel) of $45,000.

The case involved a 36-year-old plaintiff who was involved in a Chicago car accident, which happened when the defendant, insured by American Family Insurance Company, allegedly failed to yield the right-of-way when his car made a left-hand turn in front of the plaintiff’s car. The plaintiff, who was the front-seat passenger in the car, suffered a wrist injury to his right arm when the deployed airbag hit his arm. The plaintiff had about 2-3 months of post-accident treatment for this wrist fracture. No invasive surgery was ever needed. The treatment consisted of pain medications, wearing a hand cast, physical therapy, and closed reduction non-invasive outpatient surgery. The defense was allowed to introduce into evidence that the plaintiff had a recent felony criminal conviction.

Plaintiff’s medical bills were about $21,000. Anthony Elman’s last settlement demand was $50,000.

Lake County Seat Belt Usage Enforcement Over Memorial Day Weekend

Illinois law requires that seat belt usage by all vehicle occupants.  As mentioned previously on this site, there is a disproportionate amount of accidents involving drunk driving on and around holiday weekends.  In response to this situation, various law enforcement agencies have created additional traffic safety enforcement campaigns in an attempt to decrease the amount of drunk driving and other infractions, such as drivers and other vehicle occupants who don’t wear seat belts.

On May 17, 2018 the Lake County Sheriff’s Office announced the Memorial Day traffic safety initiative.  The details can be found in the media release titled “Sheriff Curran Announces Memorial Day Traffic Safety Patrols.”

An excerpt from the release:

Sheriff Mark Curran stated, “The Memorial Day holiday kicks off the summer travel season. Our goal is to make sure the summer travel season is safe for motorists and their passengers. Drunk drivers will be arrested, and we are reminding motorists and passengers to buckle up.”

Chief Petrillo further stated, “Click-It or Ticket isn’t about citations, it’s about safety. According to IDOT, Illinois has a 93.8% observed seat belt usage rate, but a disproportionate number of fatalities involve unbelted motorists and passengers. Of the 1,093 traffic deaths in 2017, where restraint use was known, 54% of those killed were not wearing seat belts. We are stepping up enforcement to prevent crash fatalities. Motorists are encouraged to buckle up and require the same for their passengers.”

Driver Who Fell Asleep While Driving Involved In Route 176 Accident

There was a car accident Friday (May 18, 2018) morning on Route 176 near Mundelein.  The crash is being attributed to a driver who fell asleep while driving, i.e. “falling asleep at the wheel.”

According to information provided by the Lake County Sheriff’s Office, the loss of control accident occurred at approximately 5:15 a.m. on Route 176 near Hawley Street.  Two cars and a truck were involved in the crash.

A Waukegan man was driving west in an Infiniti G35 and fell asleep behind the wheel, a Lake County sheriff’s police spokesman said.

His car hit a Nicor truck driven by a 55-year-old Carpentersville man and then a Chevrolet Cruze driven by a 58-year-old Fox River Grove woman. Both of those vehicles were headed east.

Following the two collisions, the Infiniti came to a rest after driving down an embankment.

The driver of the Infiniti was taken to Advocate Condell Medical Center in Libertyville for treatment of his accident injuries, as was the truck driver.

The driver of the Chevrolet Cruze also went to the hospital for medical treatment.

None of the accident injuries were considered to be life-threatening in nature.

The driver of the Infiniti, identified as Oliver Lopez, 20, was ticketed as seen in the article mentioned above.

Fatal Bicycle Accident Involving Hit & Run In Barrington Hills

There was a fatal bicycle accident late Friday (May 11, 2018) in Barrington Hills.  The accident was a “hit & run” accident, i.e. the vehicle that hit the bicyclist left the accident scene.

An excerpt regarding the fatal bicycle accident, from the May 12, 2018 Daily Herald article titled “Police search for driver who struck and killed bicyclist in Barrington Hills“:

The victim, identified by the Cook County medical examiner’s office as 28-year-old Rafal Ryndak of Schiller Park, was thrown several feet from his bicycle and was unresponsive when first responders arrived to the crash scene after 10 p.m. on Route 59 south of Route 68, according to Barrington Hills police.

Ryndak was declared dead at the accident scene, according to the Cook County Medical Examiner’s Office.  A subsequent autopsy listed multiple injuries as the cause of death.

The fatal bicycle accident remains under investigation by the Barrington Hills Police Department and the Major Crash Assistance Team.

Police believe that the vehicle was a dark-colored 2010 Toyota Sequoia SUV or a 2007 or newer Toyota Tundra pick-up truck.

Police ask those who may have information concerning the accident and/or the driver to contact police at (847) 551-3006.

Route 41 Pavement Buckling Traffic Hazard In Highland Park

There are many types of road hazards that can cause a significant threat to safe travel.  On this site, various types of road hazards have been discussed in posts found under the “Traffic Safety” category.  In many cases serious accidents and injuries have occurred due to traffic hazards.  One reason that accidents are likely to happen is that in many cases traffic hazards can suddenly and unexpectedly happen, and as such they can be difficult for drivers to react to.

There was an unexpected pavement buckling that occurred on Route 41 on Tuesday (May 1, 2018) in Highland Park.  The pavement buckling road hazard occurred in the southbound lanes between Clavey Road and Lake Cook Road.  The left lane buckled, and the rise in the pavement was said to be about 2+ feet tall.  It is unclear if any car accident or injuries occurred because of the buckling, which suddenly happened early in the afternoon.

Weather had changed recently, with a large increase in temperatures.

The left lane of southbound Route 41 north of Lake Cook Road has been closed after a buckle emerged, according to an alert from the city of Highland Park.

Lake County Distracted Driver Enforcement Initiatives Results

In the April 13, 2018 post (“Lake County Driver Distraction Traffic Safety Problem“) a recently announced distracted driver enforcement initiative was highlighted, and the problem of driver distraction was discussed especially as it relates to Lake County.

Results of the Lake County Sheriff’s Office enforcement initiative as well as results from Lake Forest have recently been announced.

An excerpt from the May 1, 2018 Lake County Sheriff’s Office media release titled “Sheriff’s Office Announces Results of Distracted Driver Campaign“:

The Lake County Sheriff’ Office issued 122 citations during the state-wide distracted driving campaign. The increased enforcement was part of the national Distracted Driving Awareness Month effort supported by the Illinois Department of Transportation.

“Driver distraction is a persistent issue in Lake County and often has life-altering consequences,” said Sheriff Curran.  “We implemented this enforcement action to encourage motorists to drop it and drive.”

As seen in the release, of the 122 citations, 94 were related to “electronic communication devices.”

An excerpt from the Lake Forest Patch article of April 30 titled “34 Distracted Driving Citations, 3 for Underage Drinking…“:

On April 19 and 20, Lake Forest police carried out two distracted driving enforcement operations around two school zones – Deerpath Middle School and Lake Forest High School – as part of an IDOT safety campaign.

Police issued 34 citations and 13 warnings to motorists for using cell phones while driving during over the two-day period.
