Bicycle Accident Injuries Characteristics And Consequences

For various reasons, bicycle accident injuries commonly occur during a crash.  As bicycling continues to grow in popularity both as a recreational activity as well as a method for commuting, there have been more miles traveled by bicycle.  As these miles increase, there is an increased possibility of bicycle accidents, especially given that many of these miles ridden are done so on roadways as well as busy paths.

Bicycle accidents have often been discussed on this site, as injuries resulting from such crashes are often serious in nature, and some lead to immediate fatalities.  As seen in bicycling accidents discussed on this site, there are a broad range of injuries that can occur if a bicyclist is injured in a crash.  Additional discussion of bicycle accidents – including common reasons for bicycle accidents, accident types, and types of injuries – are further discussed on the “Lake County IL Bicycle Accidents” and “Regarding A Bicycle Accident” pages.

As bicycle accidents often cause serious injuries that often require extensive medical treatment including hospitalization – and possibly other medical care such as surgeries and rehabilitation – medical costs directly resulting from bicycle accidents are often substantial.  As well, if the injuries cause a temporary or permanent inability to work, there may be other financial challenges due to the loss of income.

Due to the expenses and other hardships caused by bicycle accident injuries, many people who have been injured due to a bicycle accident choose to file a lawsuit if the accident was not their fault.

One bicycle accident that involved serious accident injuries is seen in the May 25, 2018 Lincolnshire Review, in an article titled “From ‘scary times’ to record times.” The article mentions a bicycle accident that involved Andrew Starykowicz, a professional triathlete.  The bicycle accident happened in August 2016.  In this case the bicyclist was hit and dragged by a truck.  An excerpt regarding the accident injuries that occurred:

Starykowicz, a Wauconda resident, was hospitalized with a slew of injuries: two fractured vertebrae, a compound fracture of his left leg, a severe concussion and numerous cuts and bruises.

Additional details and possible updates concerning bicycle accident injuries can be seen in the sources mentioned above.

Court Rulings Regarding Bicycle Accident On Skokie Valley Bike Path

There has been a notable Lake County bicycle accident in which the Illinois State Supreme Court has made a ruling.  The alleged bicycle accident, in which the bicyclist suffered various injuries, happened on the Skokie Valley Bike Path in Highland Park.

The bicycle accident lawsuit, as well as the subsequent court rulings, is discussed in a variety of media sources, including the December 18, 2017 Highland Park News article titled “Cyclist’s lawsuit against Highland Park revived by Illinois Supreme Court” as well as the December 18 Highland Park Patch article titled “Supreme Court Rules Against Highland Park Patch In Bike Trail Lawsuit.”

As seen in the articles, the plaintiff, Kathy Corbett, was involved in a bicycle accident on the path in August 2013.  Her injuries allegedly included broken ribs, a punctured lung, and a broken wrist, along with forearm and head injuries.

An excerpt regarding the crash, from the Patch article:

Kathy Corbett was seriously injured in a cycling accident on Aug. 21, 2013 while riding with a group along the Skokie Valley Bike Path just north of Old Deerfield Road, according to court filings. A rider in front of her hit a bump in the path and crashed, blocking her path. She ended up riding over him and crashing, suffering a series of injuries.

Two excerpts regarding the court rulings and appeals, from the Highland Park News article:

In December 2015, a Lake County Circuit Court judge granted motions for dismissal filed by the City of Highland Park and Lake County. The defendants said they were shielded from liability for injuries under a section of the state’s local government immunity act. The section states, “Neither a local public entity nor a public employee is liable for an injury caused by a condition of … any hiking, riding, fishing or hunting trail.”

Corbett appealed the ruling with respect to the City of Highland Park, and an Illinois Appellate Court reversed the lower court’s finding. The city appealed to the Illinois Supreme Court.

also:

In a 15-page opinion released Nov. 30, the Illinois Supreme Court found that absolute immunity does not apply to the Skokie Valley Bike Path or other trails improved with asphalt, concrete, crushed aggregate or similar finishes.

Additional details and possible updates concerning this Lake County bicycle accident and subsequent lawsuit and court rulings can be seen in the sources mentioned above.
