Lawsuit Filed Over Lake Villa, Illinois Boating Death

The July 30th post, titled “10-Year-Old Boy Killed During Boating Accident In Lake Villa, Illinois” summarized a July 28 boating accident that led to the death of Tony Borcia, of Libertyville.

Now, the family of Tony Borcia has filed a wrongful death lawsuit against the boater and his passenger whose boat struck Tony Borcia.

The lawsuit is filed against the boater, David Hatyina, 51, of Bartlett, and his passenger, Renee Melbourn.

An excerpt from the Chicago Tribune article of December 14, titled “Family files suit in boy’s boating death” :

The lawsuit, filed Thursday, claims that Hatyina was under the influence of alcohol and/or drugs when, the suit asserts, he operated his 29-foot Baja Outlaw without a lookout, at an unsafe speed and in a reckless and dangerous manner, and failed to yield the right of way.

According to prosecutors, for the accident Hatyina has been charged with reckless homicide and aggravated driving under the influence of alcohol and cocaine.
