Anthony R. Elman of Elman Law Group, LLC has successfully achieved a $621,000 jury verdict involving a wrist fracture stemming from a Chicago car accident. The case, John Calhoun vs. Peter Ochoa, was tried in Cook County Circuit Court, Chicago, Illinois.

Elman Law Group took the case to trial after there was a Last Offer to Settle by Defendant (American Family Insurance In House Counsel) of $45,000.

The case involved a 36-year-old plaintiff who was involved in a Chicago car accident, which happened when the defendant, insured by American Family Insurance Company, allegedly failed to yield the right-of-way when his car made a left-hand turn in front of the plaintiff’s car. The plaintiff, who was the front-seat passenger in the car, suffered a wrist injury to his right arm when the deployed airbag hit his arm. The plaintiff had about 2-3 months of post-accident treatment for this wrist fracture. No invasive surgery was ever needed. The treatment consisted of pain medications, wearing a hand cast, physical therapy, and closed reduction non-invasive outpatient surgery. The defense was allowed to introduce into evidence that the plaintiff had a recent felony criminal conviction.

Plaintiff’s medical bills were about $21,000. Anthony Elman’s last settlement demand was $50,000.

Lake Villa Crash Results In Life-Threatening Injuries To Driver

A Lake Villa crash occurred on Tuesday (April 9, 2019) afternoon, which involved a “head-on collision.” The collision occurred at Route 83 and Townline Road, just to the south of Grass Lake Road. This Lake Villa crash resulted in one driver being injured with what were considered life-threatening injuries, and another driver also being injured and taken to the hospital.

The crash involved a pickup truck and a SUV. First responders began to go to the accident scene at approximately 12:48 p.m.

Witnesses told investigators with the Lake Villa Police Department and the Lake County Major Crash Assistance Team that the pickup was northbound and weaving when it ran into the southbound lane and stuck the SUV causing it to roll onto its side, according to a police statement.

The pickup truck driver sustained the life-threatening injuries. The driver of the SUV was also taken to the hospital for treatment of accident injuries.

North Chicago Fatal Crash At The Intersection Of Route 43 And Route 137

A North Chicago fatal crash occurred on Friday (March 29, 2019) at the intersection of
Route 43 and Route 137 around noon. This North Chicago fatal accident happened at approximately just after noon.

Details on the accident appear limited at this time. The cause and circumstances regarding the crash do not appear to be publicly available at this time. As well, fault in the crash does not appear to be publicly disclosed. An accident investigation into this fatal Lake County crash is ongoing.

This North Chicago fatal crash led to the death of a passenger in one of the vehicles. The decedent was identified by the Lake County Coroner as Rebecca Heraver, 23, of Gurnee.

North Chicago Sgt. Curtis Sellers said the accident occurred Friday at the intersection of routes 43 and 137 around noon.

Sellers said a Dodge Intrepid, in which Heraver was a passenger, was traveling southbound on Route 43 and turning eastbound on Route 137 (Buckley Road) when it collided with a Ford Freestar mini-van that was southbound on Route 43. The drivers of both vehicles were taken to a local hospital after the crash, he said.

Both drivers were taken to local hospitals for treatment of their accident injuries. The type and severity of these injuries does not appear to be publicly disclosed.

The accident investigation is being conducted by the Lake County Coroner’s Office, the North Chicago Police Department, and the Major Crash Assistance Team.

Fatal Tri-State Tollway Crash Near Route 176 Involving ISP Trooper

There has been a fatal Tri-State Tollway crash near Route 176. This fatal Tri-State Tollway crash is being attributed to a “wrong-way” driver. The person killed was an Illinois State Police (ISP) Trooper identified as Gerald Ellis, 36.

At the time of the crash Ellis was driving home as his shift had ended. The crash happened early this morning (March 30, 2019) at approximately 3:25 a.m. near mile post 16.75 in Green Oaks.

Ellis was pronounced dead after being taken to a local hospital.

As can be seen in the accident scene photo, his ISP SUV was severely damaged in the front, which indicates that this crash was likely a “head-on collision,” which is common during “wrong-way driver” accidents.

The driver who was driving in the wrong direction at the time of the crash also died. He was later identified as Dan Davies, 44, of Calumet City.

The accident remains under investigation. It is unknown at this time as to whether the “wrong-way driver” was impaired at the time of the collision; however, the Lake County Coroner has indicated that alcohol consumption was likely a factor in the crash.

It is typical for drivers who drive in the wrong direction to be impaired either by alcohol or by drug use. If the driver is impaired by alcohol consumption, the level of impairment is often substantial.

Route 41 Single-Vehicle Crash North Of Westleigh Road

A Route 41 single-vehicle crash occurred early Friday (March 29, 2019) north of Westleigh Road. At the time of the crash, the vehicle was traveling northbound. One person died and three other people were injured. The woman that died was later identified as Sierra Riley, 20, of Zion.

Details regarding this Route 41 single-vehicle crash are limited at this time. The reason for the crash is not known at this time; however, according to at least one source excessive speed may have played a role in the crash.

Lake Forest police and fire responded to the single-vehicle crash on northbound Route 41, north of Westleigh Road, at 3:56 a.m.

Authorities said the vehicle appeared to have been heading north when it left the highway at a bend in the road. It hit several trees before coming to a rest down a steep embankment.

This Route 41 single-vehicle crash remains under investigation by the Lake Forest Police Department and the Lake County Major Crash Assistance Team.

Fatal Wauconda Collision Along Route 12 Involving Two Cars

There was a fatal Wauconda collision Friday (March 15, 2019) night. The accident occurred along Route 12.

Police were called to the accident scene at 10:15 p.m. According to a news release from the Wauconda Police Department, the fatal Wauconda collision occurred when a southbound Hyundai Elantra crossed the center median and went into the northbound lanes. The car then collided with an oncoming Ford Focus.

The Ford Focus had four occupants; the 16-year-old female driver; two 14-year-olds and one 15-year-old. All of these four occupants were from McHenry.

The Elantra’s sole occupant was a 18-year-old man from Cary.

All of the occupants from both vehicles were hurt. The drivers had to be extricated from their vehicles. One of the 14-year-old passengers was taken to Northwestern Medicine McHenry Hospital for medical treatment. The remaining vehicle occupants were taken to Good Shepherd Hospital near Barrington for treatment of their accident injuries.

The 16-year-old female driver later passed away from her accident injuries. She was later identified as Danielle Thomas. She attended McHenry West High School.

This fatal Wauconda collision remains under investigation, and charges are reported to be pending.
