Lawsuit Filed In Death Of Construction Worker Struck By Semi In Elmhurst Illinois

On September 12, a construction worker was hit and killed while working on a road construction project in Elmhurst, Illinois.  Now, his wife has filed a lawsuit again Adan’s Trucking, Inc. and the driver that hit her husband.

The construction worker was Daniel Green, 38, of Fontana, Wisconsin.  The accident occurred while he was working near the intersection of U.S. 20 West and York Road in Elmhurst.

According to the lawsuit, Green was working 2 to 3 feet northwest from the right curb of the right turn lane when the driver of the truck made an improper turn, thereby striking Green with his rear tandem wheels. Green was taken  to Elmhurst Memorial Hospital where he was pronounced dead.  According to both the DuPage County Coroner’s office as well as the Illinois State Police, Green likely died of “massive traumatic injuries.”

The driver of the truck is Martin Montelongo of Chicago.  He was cited with improper turning and improper display of a license plate.

The lawsuit was filed in Cook County Circuit Court on Friday.  The amount that the lawsuit seeks has not been specified.
