Remote Civil Jury Trial To Be First Conducted In Illinois

In-person jury trials are set to resume in Lake County next month for the first time since the emergence of coronavirus in Illinois. But first, the county is scheduled to make “virtual” history.

While hearings have been proceeding via Zoom video teleconferencing software for nearly a year, the six-person panel scheduled to be seated Wednesday to render a verdict on a civil case involving a traffic crash in Mundelein will mark the first remote jury trial in Illinois history, according to a court spokesperson.

This remote civil jury trial regarding the Mundelein traffic crash involves a woman who alleges injuries due to a vehicle collision. The plaintiff’s vehicle was “rear-ended” by another vehicle whose driver had bumped the back of the plaintiff’s vehicle after the driver had reached down to pick up a cookie that had fallen to the floor of the vehicle.

Neither vehicle sustained damage. The plaintiff did not believe she was injured at the time of the accident. However, after she went to Target she felt pain in the back and neck, and went to the Emergency Room (ER) for medical evaluation and treatment.

After this hospital visit she had physical therapy (PT) for four months. She is seeking injury compensation related to the traffic accident. The defense hired an expert witness – a nurse billing expert – who will testify that the medical bills are excessive and unreasonable.
